In late December of 2023, the New York Times filed a lawsuit against OpenAI and Microsoft claiming the use of its articles to train AI models was a violation of copyright laws which could lead to financial harm. Lawyers for the Times are seeking monetary compensation as well as a ban on unlicensed use of the NYT's content. But unraveling the NYT's content from current versions of ChatGPT would be nearly impossible, and OpenAI will likely make the case that its use of the Times' content falls under fair use. Will both parties find an amicable way to settle the matter, or will they roll the dice on a risky trial that could upend copyright law as we know it?
