
To satisfy the Payout Criterion, the federal government must, through executive action or because of a bill that has become law, mandate that an employer who is not a governmental entity, federal contractor, or vendor use E-Verify to verify the immigration status of at least one employee who is not a federal employee or a graduate who is eligible for Optional Practical Training authorization granted by U.S. Citizenship and Immigration Services. This may include a requirement that the employer use E-Verify or be subject to some penalty.
