The Payout Criterion for the Contract encompasses the Expiration Values that the Supreme Court has issued a decision holding that the Secretary of Homeland Security’s termination of Haiti’s Temporary Protected Status designation is not barred by respondents’ Administrative Procedure Act or equal-protection challenges, either because those APA claims are unreviewable under 8 U.S.C. § 1254a(b)(5)(A) or because the APA and equal-protection claims fail on the merits. The market resolves to No if the Court dismisses the case, DIGs the writ, remands without deciding whether the Haiti TPS termination may lawfully take effect against those challenges, or otherwise disposes of the case without a merits ruling sufficient to uphold the termination.
